These Terms govern the use of the website remesla.com.ua.

General Provisions

These Terms of Use (the “Terms”) govern the use of the website remesla.com.ua (“Remesla”). By using Remesla, with or without registration, including by placing an order, you agree to these Terms. If you do not agree with any provision, please do not use Remesla.

Remesla is an online marketplace that connects sellers and buyers. Remesla offers two types of products:

  • products from independent sellers — craftspeople, manufacturers and entrepreneurs who list, sell and ship their products themselves;
  • products sold by Remesla — products from partner suppliers that Remesla offers on the website and that the supplier ships directly to the buyer.

The seller of each product is indicated on that product’s page.

These Terms apply together with the Privacy Policy and the “Payment and Delivery” and “Returns Policy” pages.

Who Can Use Remesla

You can browse products and place orders without registering.

An account is required to:

  • list products and publish posts;
  • accept and fulfil orders as a seller;
  • view your order history in your personal account.

By using Remesla, you confirm that you have the legal capacity required under the laws of Ukraine to enter into the relevant transactions, or that you are acting with the consent of your legal representative.

You are responsible for the accuracy of the information you provide during registration, in your profile and when placing an order, and for keeping access to your account secure.

Each user may have only one account. Sharing account access with third parties is prohibited.

Registration and Account

You can register with an email and password or with a Google or Facebook account. Authentication is provided by a separate service, AWS Cognito. Your password is stored only there, and Remesla has no access to it. You can list products and publish posts only after confirming your email.

In “Settings”, a seller can provide an email, phone number, profile photo and description, and delivery and payment methods. The profile photo and description and the delivery and payment methods are visible to all visitors. A seller’s phone number and email are visible only to a buyer whose order the seller has confirmed. Likewise, a seller can see a buyer’s phone number and email only after confirming that buyer’s order.

Placing an Order

The buyer adds a product to the “Cart” and places an order, providing their name, phone number, email and preferred delivery and payment methods. No registration is required.

After the order is placed:

  • The seller receives the order: the list of products, the total amount, and the delivery and payment methods.
  • The seller confirms or declines the order.
  • Once the order is confirmed, the buyer can see the seller’s phone number and email, and the seller can see the buyer’s phone number and email.

Neither party’s contact details are shown until the seller confirms the order. This protects both sellers and buyers from spam and fraud.

For products with a negotiable price, the buyer can offer their own price. Order statuses: Bargaining → New → Confirmed → Shipped → Completed, or Cancelled. More details are available in the Help Center.

Products from Independent Sellers

The sales contract for a product from an independent seller is concluded directly between the buyer and the seller. Remesla is not a party to this contract and is not the seller of the product. We also do not act as a commission agent or representative of either party and are not a payment agent. The buyer and the seller agree on and make payment for the product between themselves. Remesla does not accept payment for products from independent sellers and does not hold funds of the parties to the transaction.

The seller is solely responsible for:

  • the quality, completeness and conformity of the product with its description;
  • the lawful origin of the product;
  • shipping the order, accepting returns and issuing refunds;
  • compliance with consumer protection, e-commerce and tax laws in respect of their business.

Remesla sets the same minimum payment, delivery and return rules for all sellers, monitors compliance with them and reviews buyer complaints. We may restrict or block the account of a seller who breaches these rules.

Products Sold by Remesla

If Remesla is indicated as the seller on a product page, the party to the sales contract is the operator of Remesla — sole proprietor (FOP) Anton Dmytrovych Surmachevskyi.

Remesla does not manufacture products; it lists them on the website on behalf of the manufacturer. The product is made or stored by a partner supplier, who ships it directly to the buyer. The supplier may be shown as the sender by the delivery service, and the shipping time is indicated on the product page.

Payment for such products is accepted by the supplier to its own account details, which the buyer receives after the order is confirmed. Remesla does not accept payments or hold buyers’ funds.

For such products, Remesla:

  • accepts and confirms orders and forwards them to the supplier;
  • is responsible to the buyer for the quality of the product and its conformity with the description;
  • tracks shipment and informs the buyer of the order status;
  • handles requests regarding returns and defects and arranges the return of products and refunds in accordance with the “Returns Policy” page;
  • ensures that consumer rights are observed in accordance with the laws of Ukraine.

Products, Posts and User Content

By listing a product or publishing a post, photo or other content, you confirm that you hold the rights to it and that it is accurate and complies with the laws of Ukraine. In particular, photos must be taken by you, or you must have the right to use them.

It is prohibited to list or publish:

  • weapons, ammunition, drugs and other restricted goods;
  • counterfeit and pirated goods;
  • adult products and content;
  • fraudulent schemes and misleading advertising.

Each product page must contain one product or one clear offer. Other people’s photos and other people’s watermarks are prohibited.

By publishing content, you grant Remesla a free, non-exclusive right to host, reproduce and publicly display it on Remesla and on its content delivery network (CDN). Without this, we cannot technically show products to buyers. This right applies only to the extent necessary for Remesla to operate and only while the content is published. You retain the copyright to your content.

Moderation and Consequences of Violations

Every new product or post, as well as any significant change to the photos, title or description of a published product, is moderated before it becomes publicly visible. We reject, with an explanation, or remove products and content that violate these Terms or the law, are misleading or are offensive.

Repeated violations, fraud or suspected fraud may result in restricted account functionality or account suspension. In urgent cases, this may happen without prior notice.

You can appeal a moderation or suspension decision via the “Support” page.

Commission and Balance

Listing and managing products is free.

For accepting an order placed through the cart, a seller may be charged a Remesla commission of 5% of the order amount, but not less than UAH 20 and not more than UAH 1,000. The commission is charged once, at the moment the order is accepted. The seller can see whether a commission applies, and its amount, before accepting the order.

The commission can be paid from the “Balance”, topped up in advance, or as a separate payment. The “Balance” is intended solely for paying the Remesla commission and cannot be used to pay for products. Remesla does not store bank card details.

Intellectual Property

The design, logo, the Remesla name, the software code and the structure of the website belong to sole proprietor Anton Dmytrovych Surmachevskyi or are used by him on lawful grounds. Copying, reproducing or using these elements without written permission is prohibited.

The rights to content published by users (photos, product descriptions, posts) remain with their respective rights holders. By publishing content, the user grants Remesla a free, non-exclusive right to host, reproduce and publicly display it on Remesla while the content is published.

Disclaimer and Limitation of Liability

Remesla is provided “as is”. We make reasonable efforts to ensure stable operation of the website, content moderation and account security. However, we do not guarantee uninterrupted or error-free operation of the website, or that every product matches its description.

Remesla is not liable for:

  • the quality, safety, legality or conformity with the description of sellers’ products;
  • the actions or omissions of buyers and sellers, including in relation to payment, delivery and returns;
  • losses arising from the use of, or inability to use, Remesla.

These limitations do not apply where the laws of Ukraine do not permit liability to be limited. Nothing in this section limits consumer rights that cannot be limited by contract under the Law of Ukraine “On Consumer Rights Protection”.

Personal Data

How we collect and process personal data, including the data a buyer provides when placing an order without registering, is described in the Privacy Policy. It forms an integral part of these Terms.

A buyer’s data is shared with the seller only to the extent necessary to fulfil the order. The seller may not use it for any other purpose.

Changes to the Terms

We may change these Terms, in particular due to changes in Remesla’s functionality or in the law. The current version is always available on this page, with the date of the last update shown at the top. Registered users will be notified of significant changes in advance. If you continue to use Remesla after the changes take effect, you agree to the updated Terms. Changes do not apply to orders placed before the update date.

Account Deletion and Termination of Access

You can delete your account yourself: “Settings” → “Account Management”. After deletion, your account, products and posts are hidden from public view. You cannot register again with the same email or the same Google or Facebook account. This action is irreversible, so please complete any active orders before deleting your account. Data that we are required by law to retain is stored in accordance with the Privacy Policy.

We may restrict or block access to an account in the event of a breach of these Terms, suspected fraud, or as required by law.

Governing Law and Dispute Resolution

These Terms are governed by the laws of Ukraine. Disputes are resolved through negotiation and, if no agreement is reached, in court with jurisdiction determined by the laws of Ukraine. Consumers may also contact the State Service of Ukraine on Food Safety and Consumer Protection.
